These terms govern your use of emoticonhq.com and any purchase you make from us. By browsing the site, creating an account, or placing an order, you accept them. If you do not accept them, please do not use the site. They are still a contract, so please read the sections that affect you.

1. Who we are

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to place an order. If you create an account, you agree to provide accurate information and to keep your password confidential. You are responsible for activity that occurs under your account. Tell us promptly if you believe someone else has accessed it. We may suspend or close an account that we reasonably believe is being used for fraud, abuse, or repeated violation of these terms.

3. Product descriptions and images

We photograph our pieces as accurately as we can, but handmade stoneware varies. Glaze pooling, slight tone differences, kiln marks, and minor variations in dimensions are normal, not defects. Screens also affect color. If a piece is materially different from its description, contact us and we will make it right.

4. Prices, availability, and errors

Prices are in US dollars unless another currency is selected at checkout. We may change prices and discontinue products at any time, but not for an order already accepted. All orders depend on stock; if an item becomes unavailable, we will offer a substitute, a partial shipment, or a refund. Despite our efforts, a price or description may contain an error. If an obvious pricing error occurs, we may cancel the order and refund you in full.

5. Orders and acceptance

Your order is an offer to buy. Our confirmation email acknowledges receipt but is not acceptance; acceptance occurs when we dispatch the goods. We may refuse or cancel an order where we suspect fraud, cannot verify the address, the item is unavailable, or the law requires it. If we cancel after payment, we refund the full amount.

6. Payment

Payment must be received before dispatch. We accept the methods displayed at checkout. Card details are handled by our payment providers and we do not store full card numbers. By paying, you confirm that you are authorized to use the payment method. If a payment is reversed or subject to an unjustified chargeback, we may suspend the account and recover reasonable dispute costs.

7. Shipping, risk, and title

Shipping timelines and charges are described in our Shipping Policy, which forms part of these terms. Risk passes to you when the carrier delivers to the address you provided, or to a neighbor or safe place under the carrier's procedures. You are responsible for a complete address and for duties or taxes charged by your country.

8. Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these terms. Nothing in that policy limits a statutory right you may have where you live; a more generous mandatory local right applies.

9. Intellectual property

The site, photographs, product designs, text, logo, and illustrations are ours or used with permission. You may view and print pages for personal, non-commercial use. You may not copy our photographs or descriptions for a competing store, resell our content, or use our name or logo in a way that suggests endorsement without written permission. User-generated content that you post remains yours, but by posting it you grant us a non-exclusive, worldwide license to display it on our site and social channels.

10. Acceptable use

You agree not to interfere with the operation of the site, attempt to gain unauthorized access to accounts or systems, scrape content at a volume that burdens our servers, upload malicious code, or use the site to harass others or violate the law. We may restrict access where we reasonably believe these rules have been broken.

12. Disclaimer and limitation of liability

We provide the site on an "as available" basis and do not promise uninterrupted operation. To the extent permitted by law, we exclude implied warranties not stated here and are not liable for indirect, incidental, or consequential losses. Our total liability for any order is limited to the amount you paid for it. Nothing in these terms excludes liability for fraud, death, personal injury caused by negligence, or any liability that cannot lawfully be limited.

14. Governing law and disputes

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Before starting formal proceedings, please contact us so we can try to resolve the issue informally. Consumers in the EU or UK retain the protection of mandatory consumer law in their country of residence and may bring proceedings there where the law allows.

15. Changes and general provisions

We may update these terms to reflect changes in our services or the law; the version in effect when you order governs that order. If a provision is unenforceable, the rest continues in effect. These terms, with our Shipping, Refund, and Privacy Policies, form the entire agreement.
