Privacy policy

This policy explains what happens to information about you when you visit emoticonhq.com, place an order, or write to our customer care team.

Who is responsible for your data

Emoticonhq is the data controller for the information described here. Our store is operated on Shopify, and our customer care address is 4820 Marigold Avenue, Suite 217, Tampa, Florida 33609, United States. We are responsible for how your information is collected and used, even when a service provider stores it on our behalf.

What we collect, and why

Information you give us. When you place an order, create an account, or contact us, you provide a name, email address, delivery and billing address, telephone number, and order details. If you ask us to keep a note on your account, such as a delivery preference or a gift message, we store that too. Payment card numbers are entered directly into our payment provider's secure form; we receive only a confirmation, the last four digits, and the card brand. We never see or store your full card number or security code.

Information created by your visit. Our servers and analytics tools record technical details such as your IP address, browser and device type, referring page, and the pages you view. This helps us understand which product pages load slowly, which sizes of bowl people compare most often, and whether a checkout step is causing frustration. We also keep a record of emails we send and whether they were opened, so we can stop sending messages to people who are not reading them.

Our legal bases

Where European or UK data protection law applies, we rely on the following legal bases: performance of a contract when we process an order and arrange delivery; our legitimate interests when we improve our website, prevent fraud, and protect our business; consent when we send marketing email or place non-essential cookies; and legal obligation when we keep records required by tax and consumer protection rules. You can withdraw consent at any time without affecting orders already placed.

How long we keep it

Order and invoice records are kept for seven years because tax authorities require it. Customer service correspondence is kept for two years after the last exchange, so that we can remember what was agreed if the same issue returns. Marketing preferences are kept until you unsubscribe, plus a short suppression record so that we do not accidentally add you again. Analytics data is retained in aggregate or for no more than twenty-six months. When information is no longer needed, we delete it or remove the details that identify you.

Who we share it with

We share only what is necessary with companies that help us run the store: Shopify for hosting and order management, payment processors for transactions, shipping carriers and fulfillment partners for delivery, email and analytics providers for communication and measurement, and professional advisers where required. Each is bound by a contract that limits their use of your information to the service they provide. We do not sell personal information or share it for cross-site behavioral advertising. If our business is sold or merged, customer information may transfer as part of that transaction; we will notify you before a new policy applies.

Cookies and similar technologies

Essential cookies keep your cart and session working and cannot be switched off through our site. Preference cookies remember choices such as currency and language. Analytics cookies help us count visits and understand how pages are used. You can refuse non-essential cookies through the banner shown on your first visit. Blocking all cookies may prevent checkout from working correctly.

Your rights

Depending on where you live, you may have the right to know what personal information we hold, obtain a copy, correct inaccuracies, delete information, restrict or object to certain processing, receive your data in a portable format, and withdraw consent. California residents may also request disclosure of categories of information collected and opt out of sale or sharing; we do not sell or share personal information as those terms are defined by the CCPA. To make a request, email emoticonhq@outlook.com with "Privacy request" in the subject line. We will verify your identity using your order history and respond within the time required by law, usually thirty days. You will not be treated differently for exercising a privacy right.

International transfers

We are based in the United States, and some service providers process data outside your country. Where information leaves the European Economic Area or the United Kingdom, we rely on standard contractual clauses or another lawful transfer mechanism and require appropriate safeguards.

Security and children

We use encryption in transit and access controls to protect your information. No system is perfectly secure, so please use a unique password for your account and tell us immediately if you suspect unauthorized access. Our store is intended for adults and we do not knowingly collect information from children under sixteen.

Changes to this policy

We may update this policy when our services or the law change. The date at the top shows the current version, and material changes will be announced on this page or by email before they take effect. Questions, concerns, or complaints can be sent to emoticonhq@outlook.com; if you are in the EU or UK, you also have the right to complain to your local supervisory authority.
